I. General Conditions

1. Object, modifications and performance

1.1. The General Conditions, the corresponding descriptions of benefits and fee schedules, which in each case are established, will regulate guided tours services offered by BITÁCORA TURISMO TIC Y TERRITORIO SC.

This service offers to the customer the possibility to book on the web http://geapp.es or on Facebook (GEAppSpain) a guided tour that will allow him to discover the city with the help of a guide officially accredited by the Junta of Andalusia.

Different routes available and other services which may be offered to the customer in a future, will be in exchange for the payment to be paid by the CUSTOMER. Such payment shall confer the CUSTOMER the right to take the tour, according to the terms and conditions of these general conditions or those established and applicable.

1.2. BITÁCORA TURISMO TIC Y TERRITORIO SC may modify the content of these General Terms mediating customer acceptance; for the communication submitted for this purpose, BITÁCORA TURISMO TIC Y TERRITORIO SC will provide the CUSTOMER with information on the amendment to these terms and conditions, and the consequences of their non opposition. The acceptance of the amendment of the General Conditions shall always be considered executed if the CUSTOMER does not reject it within four weeks after the receipt of the communication notifying the modification. If the CUSTOMER communicates his refusal to BITÁCORA TURISMO TIC Y TERRITORIO SC within that period of time, the General Conditions under which the agreement took place shall remain in force.

1.3. The General Conditions shall prevail over any general condition that could claim the CUSTOMER, unless expressly contrary agreed in which BITÁCORA TURISMO TIC Y TERRITORIO SC expressed his acceptance in writing.

2. Rights and obligations of the parties

a) CUSTOMER

2.1. The CUSTOMER is entitled to hire the service of guided tours according to the General Conditions in each case agreed.

2.2. The CUSTOMER must pay the agreed compensation for each service or services under the terms and forms contained in the Schedule and price lists.

2.3. The CUSTOMER must provide BITÁCORA TURISMO TIC Y TERRITORIO SC with their correct and complete data to make the reservation. It undertakes, therefore, to inform BITÁCORA TURISMO TIC Y TERRITORIO SC immediately of any changes in the information provided and this modification must be confirmed again to BITÁCORA TURISMO TIC Y TERRITORIO SC, at its request, within 15 days from the date of the modification.

CUSTOMER must provide the following information:

Name, address, email, telephone (optional), age and country of origin. In the event that the customer is a legal entity (a business), it will also facilitate its legal form.

2.4. The CUSTOMER has the responsibility at all times to check the dates of the contrated guided tour services and arrive at least 10-15 minutes prior to the beginning of the guided tour to avoid delays. If the customer does not arrive on time at the agreed meeting point, BITÁCORA TURISMO TIC Y TERRITORIO SC reserves the right to start the tour without the CUSTOMER. In this case, the CUSTOMER must understand that there will be no refund by the company.

2.5. The CUSTOMER shall not use the Services in a manner contrary to good faith and in particular, so merely illustrative, not involving any of the following acts:

A use that is contrary to Spanish law or infringes the rights of others.

The CUSTOMER agrees to keep proper behaviour and to respect all members of BITÁCORA TURISMO TIC Y TERRITORIO SC and the rest of the customers. In case of default, BITÁCORA TURISMO TIC Y TERRITORIO SC reserves the right to deny the participation of the CLIENT in any of the services offered by the company without any refund. The company is not responsible for delays in completing the journey involving passengers travel connections (flights, trains, buses, etc ...). However BITÁCORA TURISMO TIC Y TERRITORIO SC has always the task of respecting the timetable.

The collection and / or use of personal data of other clients without their express consent or contravening the provisions of Law 15/1999, of December 13, about Protection of Personal Data.

2.6. No minors traveling alone allowed. Adults are responsible for children and they have to accompany them.

2.7. CUSTOMER agrees to carry at all times a document that identifies him (identity card or passport).

2.8. In case of violation of any of the obligations specified, BITÁCORA TURISMO TIC Y TERRITORIO SC is entitled to terminate the contract with the CLIENT without being the CLIENT entitled to any claim. Similarly, BITÁCORA TURISMO TIC Y TERRITORIO SC is entitled to discontinue providing service 48 hours prior written notice, which may also be made via e-mail and, if applicable, to the subsequent cancellation of the notification.

b) BITÁCORA TURISMO TIC Y TERRITORIO SC

2.9. BITÁCORA TURISMO TIC Y TERRITORIO SC ensures that the contracted services will be provided in the manner established in these Terms and Conditions.

2.10.CUSTOMER can only require depending on the contracted services.

2.11. BITÁCORA TURISMO TIC Y TERRITORIO SC provides a guarantee of performance of the Services that empowers the CUSTOMER to receive a full or partial payment of the fees paid in the event that it is suspended for an error attributable to BITÁCORA TURISMO TIC Y TERRITORIO SC.

BITÁCORA TURISMO TIC Y TERRITORIO SC reserves the right to permanently close the above right in the event that the CUSTOMER severely violates its obligations.

2.14. BITÁCORA TURISMO TIC Y TERRITORIO SC is not responsible for:

2.14.1. BITÁCORA TURISMO TIC Y TERRITORIO SC is not responsible for possible changes in outsourced services, whether BITÁCORA TURISMO TIC Y TERRITORIO SC has provided any assistance to obtain them. For cancellations or problems with third companies through no fault of BITÁCORA TURISMO TIC Y TERRITORIO SC, the CUSTOMER must go to that third company to make the appropriate claims within the terms and conditions of that third company. BITÁCORA TURISMO TIC Y TERRITORIO SC will not be legally or financially responsible for damages caused by third parties. These third parties include restaurants, hotels, buses, tourist attractions, and other companies contracted to carry out the various tourist activities.

2.14.2. BITÁCORA TURISMO TIC Y TERRITORIO SC is not responsible for possible changes in itineraries due to adverse weather conditions. The company is not responsible for events that are beyond the control of the activity, such as weather events, or events beyond our control that impede the total or partial execution of the activity.

These interruptions will be communicated, as far as possible, with sufficient advance to the CUSTOMER. The foregoing obligation shall not be required to BITÁCORA TURISMO TIC Y TERRITORIO SC in cases of force majeure or for reasons beyond their will and control.

2.14.3. BITÁCORA TURISMO TIC Y TERRITORIO SC is not responsible, under any circumstances, for any accidents, damage, or loss of life that the client suffers in any of our walking tours.

2.15. BITÁCORA TURISMO TIC Y TERRITORIO SC reserves the right to limit the number of places of customers who come to visit without reservation.

2.16. BITÁCORA TURISMO TIC Y TERRITORIO SC may transfer rights and obligations under these Terms to one or more third parties. In this case, the customer may terminate the contract immediately.

2.17. BITÁCORA TURISMO TIC Y TERRITORIO SC freely choose the technical means, which may be related to technology and / or infrastructure, in order to facilitate the provision of services.

2.18. BITÁCORA TURISMO TIC Y TERRITORIO SC is not responsible for damages of any nature that may be caused to a third party or client as a result of improper or illegal use of the Services by the CUSTOMER.

2.19. Any claim by the CUSTOMER referred to BITÁCORA TURISMO TIC Y TERRITORIO SC must be submitted in writing, which can also be made by electronic mail ( "info@geapp.es") if the CUSTOMER adds to the claim his full name, NIF / DNI / CIF , address, e-mail, telephone and the name of the owner of the service, and provides the electronic document with an electronic signature in accordance with current regulations. The claim about defects and interruptions is excluded if it is not alerted on time.

Following the notification to BITÁCORA TURISMO TIC Y TERRITORIO SC about defects and interruptions objects of the claim, the CUSTOMER shall allow a period of 20 days to BITÁCORA TURISMO TIC Y TERRITORIO SC to respond the client. During this period, the customer may not exercise any action against BITÁCORA TURISMO TIC Y TERRITORIO SC nor terminate the contract because of such defects and disruptions.

2.20. BITÁCORA TURISMO TIC Y TERRITORIO SC will be responsible for every case of damage resulting from a breach of contract which is due to an intentional or grossly negligent behavior by BITÁCORA TURISMO TIC Y TERRITORIO SC or one of the persons from whom BITÁCORA TURISMO TIC Y TERRITORIO SC has in its team to fulfill its obligations. If the breach of contract does not occur in a severely reckless and willful manner, responsibility of BITÁCORA TURISMO TIC Y TERRITORIO SC is limited to the amount of damage expected or those which could have foreseen at the execution of the contract.

In any case, unless contrary legal mandatory, the quantification of the aforementioned liability is limited to the consideration actually paid by the CUSTOMER to BITÁCORA TURISMO TIC Y TERRITORIO SC for contracted services.

3. Licensing, Intellectual Property

BITÁCORA TURISMO TIC Y TERRITORIO SC is the owner or, where appropriate, is authorized for use by the rightful owner of all copyrights, trademarks, intellectual property rights, know-how and any other rights related to the services contracted by the CUSTOMER as well as computer programs necessary for its implementation and the information it obtains.

CUSTOMER must respect the use of third party programs made available by BITÁCORA TURISMO TIC Y TERRITORIO SC although they were free, those for which BITÁCORA TURISMO TIC Y TERRITORIO SC has the necessary exploitation rights.

CUSTOMER, under the General Conditions, does not acquire absolutely no rights or licenses on the services provided on computer programs or applications necessary for providing the services, with the exception of the Rights and licenses necessary for the fulfillment of the General Conditions and only for the duration of the contracted services.

CUSTOMER agrees to ensure that any person realizing guided tours shall respect the conditions of use thereof.

4. Fees and payment

4.1. Rates included on the lists are fixed rates. Rates depend on tour to take, contained on the website http://geapp.es. Rates are related to the use or consumption and will be billed before taking the tour chosen in each case.

4.2. BITÁCORA TURISMO TIC Y TERRITORIO SC can increase the amount of fees providing the accurate information on the website http://geapp.es.

4.3. CUSTOMER shall be informed about the final price, including taxes, to formalize the process of buying and always before sending the request by the customer to BITÁCORA TURISMO TIC Y TERRITORIO SC.

4.4 If a change in the taxation of the services agreed occurred, BITÁCORA TURISMO TIC Y TERRITORIO SC may adjust their prices accordingly.

4.5. Depending on the service provided and the payment method provided by BITÁCORA TURISMO TIC Y TERRITORIO SC, payment of invoices will be made through Paypal services, bank account or credit card.

4.6. In case of non-payment of the invoice, CUSTOMER shall bear the costs of all payment requirements, and the cost of the returning bank receipt and all other expenses attributable to the client for this reason, including fees and expenses related to BITÁCORA TURISMO TIC Y TERRITORIO SC lawyers. Likewise, the customer may not use any route until payment occurs.

4.7. The CUSTOMER who arrives at the time and at the place fixed for taking the route, without reservation, must pay in cash at the beginning of the tour.

4.7 BITÁCORA TURISMO TIC Y TERRITORIO SC reserves the right to suspend services due to any incident experienced in the collection of the same and / or non-payment.

5. Termination of the contract

5.1. Contractual relations between BITÁCORA TURISMO TIC Y TERRITORIO SC and the CUSTOMER which did not have a fixed term may be terminated by either party at any time without justification.

5.2. CUSTOMER can request the removal of his data from BITÁCORA TURISMO TIC Y TERRITORIO SC. database. Such request will generate a confirmation e-mail from BITÁCORA TURISMO TIC Y TERRITORIO SC, which will contain a link which the client must click to complete the procedure for deleting the user. In any case, the request does not generate any economic right in favor of THE CUSTOMER saving upon the occurrence cause.

6. Personal Data Protection

CUSTOMER agrees that usage data, such as the establishments visited, routes unloaded and any other similar data can be used for statistical purposes. In any case personal data or payments to third parties will be provided and will not be used for purposes other than stated here.

BITÁCORA TURISMO TIC Y TERRITORIO SC manifested the utmost respect and attaches great importance to the protection of CUSTOMER data, the decisions on the use of his data will be respected in any case.

BITÁCORA TURISMO TIC Y TERRITORIO SC complies with Organic Law 15/1999, about Protection of Personal Data and other regulations in this area, and maintains a Privacy Policy on personal data, which essentially established the use of personal data. BITÁCORA TURISMO TIC Y TERRITORIO SC informs CUSTOMERS in detail of the essential circumstances of such use and security measures that apply to their personal data to prevent unauthorized parties from accessing them.

7. Right of cancellation of the reserved guided tour before taking it.

7.1. You may cancel a reservation if the cancellation occurs 48 hours before conducting the tour. Otherwise the amount realized will be returned. The weather conditions will not be, under any circumstances, a reason for cancellation.

7.2. Cancellation of the reservation must be communicated by the CUSTOMER to BITÁCORA TURISMO TIC Y TERRITORIO SC, via e-mail to "info@geapp.es" mentioning his full name, NIF / DNI / CIF, e-mail, phone and the owner service.

8. Governing Law and Jurisdiction

8.1. As provided in these Terms and Conditions as well as in the interpretation and resolution of conflicts that may arise between the parties, Spanish law will apply.

8.2. Parties are subject to the final resolution of all disputes resulting from the contractual relationship by the courts or competent courts that will result in each case.

9. Severability

Should one or more of the provisions of the General Conditions prove invalid, the validity of the remainder will not be affected.

10. Content that may be offensive.

10.1 BITÁCORA TURISMO TIC Y TERRITORIO SC informs users that some of the content included in guided could dismay, annoy, offend or offend the CUSTOMER during the tours.

10.2 BITÁCORA TURISMO TIC Y TERRITORIO SC reminds the CUSTOMER of legal age that he is responsible for minors so it is his responsibility to determine what services and content is or is not appropriate for the age of children.

10.3 BITÁCORA TURISMO TIC Y TERRITORIO SC is not responsible for any damages that may experience the CUSTOMER during his participation in our tours.
